**{Company} Supreme Court has spared a convicted person, who was married to the victim, from undergoing jail time under the Protection of Children from Sexual Offences Act. This was done citing systemic failures and the need to ensure justice for the adolescent girl and her child.

**"This year we’ve marked the 75 years of the Constitution on January 26th. The Constitution denotes the State as a Welfare State. The Constitution favorable social and economic justice to all citizens. Currently, there’s a failure by the State to ensure both social and economic justice to the victim," Supreme Court verdict said.

"Due to the failure of the welfare concept, this case is being addressed," it added.
**"To address this situation, the obligation falls upon the State to be a true guardian of the victim and her child, ensuring a happy, healthy and constructive life, " it said.

The case crystallized around a 2018 incident in West Bengal where a 14-year-old girl left her home to seek support from a 25-year-old man, fathering a child. The man was found guilty under Section 6, POCSO Act, and National Penal Code (IPC).
However, without thorough justice, the Calcutta High Court later believed the situation and overturned the conviction, citing consent as a material aspect and the current state of the family.
